1. Description of Service

Mystic Crew is a vessel management and maintenance tracking platform designed to assist vessel owners, captains, crew members, yacht managers, and marine service providers with organizing vessel information, maintenance schedules, inspections, inventory, service records, documents, and related operational information.

The Service is provided as an organizational and recordkeeping tool only.

2. User Responsibilities

You are solely responsible for:

• The operation and seaworthiness of your vessel(s)
• Compliance with all applicable laws, regulations, and maritime requirements
• Maintenance schedules and inspections
• Verification of all information entered into the Service
• The accuracy of maintenance records and service histories
• The actions of users authorized under your account

Mystic Crew does not assume responsibility for vessel maintenance, inspections, repairs, safety procedures, regulatory compliance, or operational decisions.

3. No Professional Advice

The Service does not provide engineering, mechanical, legal, tax, regulatory, safety, navigation, or professional advice.

Any information provided through the Service is for organizational purposes only and should not be relied upon as a substitute for professional judgment, inspections, or maintenance planning.

4. Maintenance Reminders and Notifications

Maintenance reminders, alerts, notifications, and scheduling tools are provided solely as a convenience. Mystic Crew does not guarantee that notifications will be delivered, received, or acted upon.

Users remain solely responsible for monitoring and performing all maintenance, inspections, safety checks, repairs, and regulatory requirements regardless of whether reminders are received.

5. Account Registration

To access certain features, you may be required to create an account. You agree to:

• Provide accurate information
• Maintain current account information
• Keep your login credentials secure
• Notify Mystic Crew immediately of unauthorized account access

You are responsible for all activity occurring under your account.

6. Data Ownership

You retain ownership of all data, documents, photos, maintenance records, inventory records, and other content uploaded to the Service.

By uploading content, you grant Mystic Crew a limited license to store, process, display, and transmit that content solely for the purpose of providing the Service.

7. Data Storage and Backups

While Mystic Crew takes reasonable measures to protect data, no electronic storage system is guaranteed to be secure or error-free.

Users are strongly encouraged to maintain independent backups of important records and documentation.

Mystic Crew shall not be liable for any loss of data, corruption of records, service interruption, or inability to access information.

8. Acceptable Use

Users agree not to:

• Interfere with system operations
• Attempt unauthorized access to accounts or systems
• Upload malicious software or harmful content
• Reverse engineer, copy, or exploit the Service without authorization

9. Subscription Fees and Billing

Unless otherwise stated:

• Subscription fees already paid are non-refundable except where required by law

Mystic Crew strives to provide reliable service but does not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, upgrades, technical issues, third-party outages, or circumstances beyond our control.

11. Limitation of Liability

To the maximum extent permitted by law, Mystic Crew, its owners, officers, employees, contractors, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages.

This includes, but is not limited to: vessel damage, equipment failure, missed maintenance, missed inspections, loss of profits, loss of data, business interruption, personal injury, or property damage arising out of or related to the use or inability to use the Service.

In no event shall Mystic Crew's total liability exceed the amount paid by the user to Mystic Crew during the twelve months preceding the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Mystic Crew and its affiliates from any claims, damages, liabilities, costs, and expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Vessel operation or maintenance decisions
• Content uploaded to the Service

13. Termination

Mystic Crew reserves the right to suspend or terminate accounts at its discretion if users violate these Terms or engage in conduct that may harm the Service or other users.

Users may terminate their accounts at any time.

14. Modifications to Service

Mystic Crew may modify, suspend, or discontinue portions of the Service at any time without liability.

15. Changes to These Terms

Mystic Crew reserves the right to update these Terms periodically. Continued use of the Service after updates constitutes acceptance of the revised Terms.

16. Governing Law

These Terms shall be governed by and interpreted under the laws of the State of California, without regard to conflict-of-law principles.

Any disputes arising under these Terms shall be resolved in the state or federal courts located in California.
